ASIC Enforcement for Sustainability Reporting Will be Different to Greenwashing
ASIC distinguishes its enforcement strategy for mandatory climate disclosures from historical greenwashing cases. While greenwashing targets misleading voluntary claims, the new mandatory regime prioritizes facilitating high-quality reporting through a pragmatic, proportional approach during its early implementation phase. To support this goal, the regulator offers temporary, phased immunities for uncertain data within required sustainability reports. This limited protection acknowledges the challenges of initial compliance but explicitly excludes voluntary sustainability statements, which remain subject to strict misleading conduct principles. This distinction is crucial for understanding greenwashing risks, as companies cannot assume that regulatory leniency for mandatory data extends to their self-selected sustainability narratives. Entities must ensure that any voluntary claims about their green credentials remain rigorous and accurate to avoid enforcement actions based on established deceptive conduct standards.
